The legal status of CBD oil in Denmark
In Denmark, is CBD legal? CBD Oil of less than 0.2 percent THC is safe as long as it meets certain laws in Denmark that govern drugs, dietary additives & milk. Lægemiddelstyrelsen ‘s view is that cannabis oil containing CBD is most certainly illegal, and is available illegally .
Although cultivating Hemp plants with less than 0.2 percent THC is not illegal, extracting CBD oil from it could be illegal .
As mentioned above, legality is a gray field, and the impacts are generally on the manufacturer and not the customer.
Cannabis and THC goods containing more than 0.2 percent of THC in Denmark are also illegal. In recent years there has been some push but the feeling is not as strong as in other EU nations.
Buying CBD oil for personal use is a murky area; whether CBD remains treated as a dietary supplement or a medical drug remains uncertain. Limits of THC in CBD products

Cannabis used in the medical field in Denmark
Recently the Danish Parliament announced plans to start a four-year medical cannabis trial starting on 1 January 2018. The announcement has been coming for a long time, which is the product of the majority government’s original plan back in 2014 .
There is only a small number of licenses available, and the race is now on for businesses to submit their plans ahead of the cut-off on 31 December. Denmark has built upon a framework already in place here in Europe for the medical cannabis industry .
After the declaration, Denmark’s medicines agency, Lægemiddelstyrelsen, provided information about the approval process. Effectively all licenses fall under one of two categories:
- Permission to make cannabis easier and grow domestically
- Authorization to import cannabis and medicinal goods into Denmark
Applicants must indicate whether they intend to participate in growing, processing, or distribution.
Licenses are available to domestic and foreign companies – but all submissions must be submitted in Danish. This is a similar strategy embraced by Germany earlier this year – but this criterion is aimed towards improving small enterprises in Denmark .
The CBD market in Denmark is growing rapidly. Industries must seek permission to cultivate cannabis from three independent regulatory bodies to receive approval:
Laegemiddelstyrelsen, Landbrugsstyrelsen Agriculture Agency, and National Police, Rigspolitiet.
Earlier this year, Aurora Cannabis, a Canadian medicinal marijuana grower located in Alberta, Ontario, created plans to partner up with tomato grower Alfred Pedersen & Son . The pharmaceutical company will use Danish-run greenhouses to grow the product in Odense.
The two firms have recently come together in a joint venture known as Aurora Nordic Hemp. They plan to build an automated facility of 93,000 sqm-set to produce 120,000 kg of cannabis per year .
The initiative is planned to meet the interests of other Nordic nations such as Sweden and Norway, in accordance with expected potential regulatory reforms .
Canopy Growth Company requires other foreign pharmaceutical firms that set up shop in Denmark. This has recently partnered with Spectrum Cannabis Denmark and plans to establish a 40,000 sqm facility in Odense as well .
