The Swiss Government takes a unique stand on cannabis possession. If it contains less than 1 percent THC (which is responsible for the psychoactive effect, or ‘high’) then buying, possessing, and consuming the substance is legal. Cannabis containing THC amounts above 1 percent, however, is known as a narcotic. Possession of opioids is illegal under the Federal Opioids and Psychotropic Substances Act: Stat. 19.

The psychoactive effect is the crucial difference. The Swiss authorities accept that the therapeutic effects of CBD (which, contrary to THC, is not psychoactive) and that it will “help people relax and alleviate pain and muscle cramps.” [1]

Any person caught using unlawful ‘narcotic’ cannabis will face a CHF 100 fine. If the amount of cannabis they are caught is less than 10 grams, then usually there is no penalty, as it has been decriminalized to possess ten grams or less. [1]

Are you allowed to sell cannabis in Switzerland?

There are also laws that must be adhered to in order to market cannabis goods lawfully. CBD is excluded from the Narcotics Act because it is not a ‘big’ drug. Nevertheless, that does not mean it should be priced freely, the government stresses. [2]

Those plants are also sold as recreational items despite the low THC levels. This created some confusion in the past because plants with high THC look and smell the same as plants with low THC. [3]

The legal status of CBD in Switzerland

Any CBD products containing less than 1% THC may be legally sold in Switzerland because they are not covered by the Narcotics Act. This is unusually high-many other European countries limit the THC content to 0.2%.

That doesn’t mean CBD oil prices are unregulated. All CBD products must be categorized according to the law and must comply with certain regulations. For example, if it is classified as a ‘foodstuff,’ it must comply with the safety guidelines of federal law. Poland has grown cannabis for its fiber and as medicinal products for centuries. When the international cannabis prohibition emerged in the 1900s, the hemp industry in Poland was devastated.

However, Poland was among the first countries to successfully restart the hemp industry since Europe reintroduced hemp in the ’90s. Poland has some of the youngest entrepreneurs in the CBD sector, its cannabis industry is thriving and CBD is already a nationally available mainstream product.

History of Cannabis in Poland

Cannabis came to Poland in the 15th century BCE from Central Asia, possibly by the Scythians. Industrial hemp has played an important role in many Slavic tribes for millennia (including those who lived on Poland’s lands), taking part in mythology, medicine, cooking, sewing, and clothes.

Hemp, along with flax, was the Poles’ most important crop. They used it for clothes, for food, and for medicine. Boiled hemp seeds were used to soothe toothaches and treat skin diseases. Hemp has also been used as a treatment for stomach upset, fever, and pain relievers.

Polish scientists and physicians studied cannabis-based drugs during the 19th century — setting the groundwork for the modern-day Polish cannabis industry.

Over the years, the long tradition of hemp cultivation has survived-even between the two world wars.

In 1930 Poland created the Institute of Natural Fibers and Medicinal Plants, one of Europe’s oldest hemp research institutes.

Following the International Opium Convention (IOC), Poland and more than 60 other countries have ratified the agreement banning the manufacture and trade of cannabis.

But cannabis was not officially banned until 1951 and was subsequently criminalized in 1997.

In the 50s hemp cultivation declined following the IOC and subsequent restrictive laws.

But Poland took action to recover its hemp fields after Europe changed its stance towards hemp and successfully reintroduced the crop. Poland today has a thriving sector of cannabis.

Hemp in Poland is entirely legal, whereas marijuana is partially decriminalized.

The UK regulatory framework for the CBD and cannabis industry is complex – To believe that anything below 0.2% THC is legal, is a myth.

The maximum permissible level of THC or CBN (both controlled substances) in the UK is 1 mg per product. This will include cannabis resin, the plant’s leaves, and buds/flowers, both in the paste and in herbal.

Cannabis and THC goods containing more than 0.2 percent of THC in Denmark are also illegal. In recent years there has been some push but the feeling is not as strong as in other EU nations.

Buying CBD oil for personal use is a murky area; whether CBD remains treated as a dietary supplement or a medical drug remains uncertain. What we do know is that CBD oil containing less than 0.2 percent of THC is no longer classified under drug laws, so one can be assured that even if CBD is classified as a possession of a medicinal product, it will not break any narcotics law [3

Limits of THC in CBD products

CBD products with a concentration of up to 0.2 percent THC is no longer regarded as a controlled substance after 1 July 2018. This means that CBD products are allowed to be possessed and sold below this limit [3]. However, the rules regulating medicinal products, food supplements, food, etc. still apply in parallel and still need to be complied with. Cannabis used in the medical field in Denmark

Recently the Danish Parliament announced plans to start a four-year medical cannabis trial starting on 1 January 2018. The announcement has been coming for a long time, which is the product of the majority government’s original plan back in 2014 [3].  

There is only a small number of licenses available, and the race is now on for businesses to submit their plans ahead of the cut-off on 31 December. Denmark has built upon a framework already in place here in Europe for the medical cannabis industry [2].

After the declaration, Denmark’s medicines agency, Lægemiddelstyrelsen, provided information about the approval process. Effectively all licenses fall under one of two categories:

  1. Permission to make cannabis easier and grow domestically
  2. Authorization to import cannabis and medicinal goods into Denmark

Applicants must indicate whether they intend to participate in growing, processing, or distribution.

Licenses are available to domestic and foreign companies – but all submissions must be submitted in Danish. This is a similar strategy embraced by Germany earlier this year – but this criterion is aimed towards improving small enterprises in Denmark [2].

The CBD market in Denmark is growing rapidly. Industries must seek permission to cultivate cannabis from three independent regulatory bodies to receive approval:

Laegemiddelstyrelsen, Landbrugsstyrelsen Agriculture Agency, and National Police, Rigspolitiet.

Earlier this year, Aurora Cannabis, a Canadian medicinal marijuana grower located in Alberta, Ontario, created plans to partner up with tomato grower Alfred Pedersen & Son [1]. The pharmaceutical company will use Danish-run greenhouses to grow the product in Odense.

The two firms have recently come together in a joint venture known as Aurora Nordic Hemp. They plan to build an automated facility of 93,000 sqm-set to produce 120,000 kg of cannabis per year [2].

The initiative is planned to meet the interests of other Nordic nations such as Sweden and Norway, in accordance with expected potential regulatory reforms [2].

Canopy Growth Company requires other foreign pharmaceutical firms that set up shop in Denmark. This has recently partnered with Spectrum Cannabis Denmark and plans to establish a 40,000 sqm facility in Odense as well [2].

Drug laws and drug penalties in Croatia

In 2001 Croatia passed and has since been updating its Drug Abuse Prevention Act (DAPA). The DAPA and the Criminal Code for Croatia regulate the drug manufacturing, possession, and trade conditions.

In Croatia, the current legislative system prohibits unauthorized cultivation, possession, and trafficking of drugs. Those who violate the law are prosecuted under the Penal Code [2]. But also, the DAPA outlines a framework for drug prevention and drug user rehabilitation.

Therefore, the possession of small quantities of drugs for personal consumption was reduced to a misdemeanor in 2013 from a criminal offense. Nowadays a fine is punishable for possession of minor quantities of drugs. The fine varies by the amount and type of drug involved and ranges from €650 to €2,600.

Illegal cultivation, manufacture, and processing of drugs without any intent to sell can result in prison sentences of up to five years. If the prosecution proves the motive of the person to distribute the drugs, jail terms will go up to twelve years [1].

Worsening circumstances, such as previous convictions, being part of a criminal network, involving children in drug trafficking, or causing serious harm to others may further increase the sentences to 15 to 20 years in prison.

Laws of Cannabis drugs in Croatia

The 2013 DAPA update created a distinction between the different illicit substances, now divided into two categories — heavy drugs and light drugs.
Cannabis is considered a light drug, and in Croatia, possession of a small amount of marijuana for personal use is considered a minor offense.

While possessing a small amount of cannabis can result in a fine of up to € 2,600, most cannabis fines range from €650 to €1,300, respectively.

But that is the thing here. The current legislative system does not specify what, and what qualifies as a ‘small’ quantity. If you are caught in Croatia with cannabis, one of two things will happen, based on the amount of weed you are found with.

When caught in Croatia with a visibly small amount of cannabis — a spliff, one or perhaps even two grams of fresh or dried cannabis flower — you can get a fine directly from the police officer who caught you. If that happens, you’ll be forced on the spot to pay the fine, but you won’t face any other legal issues.

If you’re caught with a larger amount of cannabis, or if the policeman who catches you suspects you’re planning to sell the weed, you’ll have to go to court.

Now, as the law does not define the maximum amount of cannabis that can be possessed in Croatia for personal use, the arresting police officer and the judge who presides over your case have the freedom to decide on your penalty based on a variety of factors and circumstances. Weighing in on the decision is the amount of cannabis in your possession, your sex, your criminal record, and other considerations [2].

Each possession case is special and Croatian judges can be either compassionate or strict. One of the interesting news about the DAPA 2013 amendment is that it allows lawmakers to try alternate solutions to incarceration for people who have been arrested possessing minor quantities of drugs and may potentially face up to six months’ prison sentences [3].

Croatian judges could recommend fines, community service, probation, and treatment for those accused of possession of drugs. Sometimes, even if the judge considers it ‘insignificant,’ the offense may be dismissed. Any lawbreakers can require up to three years to undergo mandatory drug rehab.

Use of marijuana medical field in Croatia

Croatia legalized medical marijuana back in 2015 after arresting a man with multiple sclerosis (MS) to keep his symptoms in check for growing weeds. His detention shocked the general public, which immediately passed a medicinal cannabis bill.

Holy stated that cannabis cultivation would help to fight climate change but she also discussed the positive economic value of the weed.
